We've hired contractors to build a couple of room additions, and we drew up blueprints and got bids on a full house once, so I'm familiar with home construction and the specifications associated.   The first room addition we did was specified in a one-page contract, very brief and vague.  Mistake!  Lots of misunderstandings, leading to hard feelings.   The next room addition we did was much better:  I wrote up a 5 page detailed specification and everyone was happier:  the contractor was able to make a more precise bid; and also didn't have to waste time asking the customers (us) what model of sink we wanted etc.  Most importantly, there were no misunderstandings and no hard feelings.  

We wrote a specification for a complete house, and it took me awhile to get all the details right:  there weren't too many examples on the web.  So I thought Id pass along my specification so others could use it as a template to start their own projects with.  Good luck!

NOTES:

 

A) Allowance Items are an estimation set forth by the contractor, and is understood, the cost of the selections by the purchaser may exceed the allowance.  It is also understood the cost of the service performed may also exceed the allowance amount.  Purchaser is required to pay the supplier direct for overages, and is responsible for those overages even if the transaction fails to close.  In the event  that purchases allowance item choices and/or services performed are less than the set allowance amount, the builder will credit back the difference at closing.

 

B) Builder may substitute items and materials of equal value if an item is not available because it is out of stock or production. Builder shall not be responsible for notifying purchaser of such changes, if the change does not affect the look or function of the home.  If the owner selects a substitute material of greater value, due to unavailability, then owner will be responsible for such overages.

 

C) Purchaser should be aware that progress on the house will not be held up to wait for a decision.  It will be purchases sole responsibility to make certain change orders are signed and paid for within three days of notification, or the work may not be done and the house will progress according to schedule. If requested changes delay the time schedule on the house, then the additional days of time delay will also be included in the change order. 

 

1.      The attached plan shows which parts of the basement are finished, and which are unfinished.  Finished parts will be finished like the main floor, as described above in the spec (sheetrock,  electrical items, paint, millwork, etc).   Unfinished parts of the basement will have  framing (including closet walls), HAVC ducts and registers,  plumbing rough-outs (water supply, sewer, and sewer vent), gas supply pipes (for fireplaces, etc), stairs, exterior doors and windows, and insulation (where required by the spec); unfinished parts will not have electrical items, interior doors, millwork, sheetrock, paint, or flooring. 

2.      Job superintendant will be available for weekly phone calls to discuss house status and issues.  Long distance calls will be at owner's expense. 

3.      Owner will make formal inspections of the house prior to drywall installation, and prior to closing.

4.      All allowances include price of materials, but exclude installation and labor costs.  Installation costs are included in overall house allowance. Exceptions (e.g. flooring, kitchen cabinets) are explicitly noted in the line items.  If owner selects allowance items (such as flooring or cabinets) from a Spokane retail store (such as Lowes or Home Depot) and contractor uses his own subcontractors, the material or installation cost will not exceed the retail cost.

5.      All allowances use actual price paid by contractor, including contractors discounts.  Sales tax not taken from allowances (except for overages in change orders).  Contractor to provide receipts for allowance items.

6.      For items with warranty specified, contractor to provide written warranty documentation.  If warranty requires specific installation steps to be done, contractor will follow those steps.

7.      If this specification calls for a particular brand or model, contractor will provide documentation when brand or model is not plainly visible.

8.      Change orders are not enforceable by either party unless they are (1) in writing; (2) include the price change; and (3) are signed by the owner.    Change orders by Fax are okay, but email is not.

9.      Contractor will insure house during construction. 

10.   Price of house includes blueprints, permits, and all necessary engineering work (roof, foundation, etc).

11.   Some requirements in this spec may exceed the local building codes or minimum construction requirements.  In those cases, it is understood that the owner desires the extra strength and is paying for it.  In those cases, the contractor will build to the specification, not the to code or minimum construction requirement.

12.   Note (B) above is modified as follows:  It is understood that owner has identified specific brands, models, part numbers, and sizes because those specific brands, models, parts, and sizes are desired by the owner and included in the price of the house.  All substitutions require a change order.  If contractor cannot obtain a specified item, contractor will promptly notify owner.   Owner has 48 hours after notification to identify a substitute item.  If owner does not, contractor can substitute an item of equal quality, appearance, and performance.

13.   Final cleaning:  House will be dusted, cleaned, and vacuumed.

14.   Contractor will repair any defects in materials or workmanship for one year after closing (except for any work done by owner).

15.   All plumbing items (faucets, sinks, etc) named in this spec are considered an allowance, and owner may substitute other items as long as the Contractor has not ordered the original item.  Change orders will be used for these substitutions, and the only costs on the change orders will be the material cost increase/decrease (and installation cost change, if the installation is different).

16.   The attached floorplan, dated April 15, 2002, is included in this specification.  All notes and figures on the floorplan are considered part of this specification.  The attached elevation diagrams are part of this specification.  The front elevation of floorplan 2223, dated 3-8-00 is used only as a guideline for exterior trim and front elevation decorations.  If there is a conflict between any of these documents, the precedence (highest to lowest) is:  This specification; attached floorplan;  attached elevations; front elevation of plan 2223.

17.   Contractor will provide lien release documents for each subcontractor upon completion of each subcontractor's job.

18.   In the event of a dispute, parties waive their right to trial and agree to binding arbitration by the Spokane BBB arbitration program.  The remedy for the house not meeting the specification is the cost to change the house to meet the specification (materials and labor) not just the material cost difference.
